Family law in Ontario is governed by the Family Law Act. It provides for equalization of the net family properties of spouses, the right to possession and redemption of the matrimonial home, the right to refuse to consent to the alienation or encumbrance of the matrimonial home, the right to spousal and child support, the right to enter into domestic contracts, the right of dependants to claim damages. Divorce in Canada is governed by the Divorce Act. Divorce is granted when there has been a breakdown of marriage. There are 3 ways to establish the breakdown of a marriage but the most commonly used way is to show that that the spouses have lived separate and apart for at least one year immediately preceding the determination of the divorce and were living separate and apart at the commencement of the proceeding. Dito sa Ontario ang "Family Law Act" ang batas na sinusunod tungkol sa "equalization of net family property" o pagpantay ng ari-arian ng magasawa, ang karapatan ng asawa na manatili sa "matrimonial home" at itubos ito, ang karapatan ng asawa na hindi pumayag sa pagbenta or pagsangla ng "matrimonial home", ang karapatan ng asawa sa suporta, ang karapatan ng anak sa suporta, ang karapatan ng magasawa o nagsasama na gumawa ng kasunduan, ang karapatan ng sinusuporta na humingi ng danyos. Sa Canada ang "Divorce Act" ang batas na sinusunod tungkol sa diborsyo. Nakakuha ng diborsyo sa korte kapag napatunayan na sira na ang pagsasama. May tatlong paraan para patunayan ito pero kadalasan ang pinapatunayan na may isang taon na naghiwalay ang magasawa.
