A will is a legal document we can use to control the distribution of our estate after we pass away. If we die without a will our estate will be distributed according to the Succession Law Reform Act of Ontario. The act will first distribute the estate between a surviving spouse or surviving issue (children). If there is no surviving spouse or children the act will give the estate to the surviving parents. If there are no surviving parents the act will give the estate to surviving brother and sisters. If there are no surviving brothers or sisters the act will give the estate to surviving nephews and nieces. If there are no surviving nephews and nieces the act will give the estate to surviving next of kin. If there are no surviving next of kin the act will give the estate to the Crown. Probate is short term for the legal proceedings wherein a person who wants to administer an estate under a will or without a will applies for court appointment or confirmation of his authority to act. Puede natin iutos ang paghahati ng ating ari-arian kahit na tayo ay patay na sa pamamagitan ng testamento. Kung tayo ay mamatay ng walang testamento ang batas ng Ontario na tinatawag "Succession Law Reform Act" ang susundin sa paghahati ng ating ari-arian. Sangayon sa batas na ito ang asawa at mga anak ang dapat unang makibahagi. Kung walang asawa or anak ang magulang. Kung walang magulan ang mga kapatid. Kung walang kapatid ang mga pamangkin. Kung walang pamangkin ang ibang kamaganak. Kung walang kamaganak pupunta sa gobyerno ang ating ari-arian. Sinoman ang may gustong mamahal sa paghahati ng ating ari-arian ay kailangan humingi ng pahitulot sa korte at ang proceso ng paghingi ng pahintulot ay tinatawag na "probate".
